1. Applicability and Contracting Party
These Terms and Conditions apply to all orders placed at EscrimaEurope.com. The contractual partner for the corresponding sales contract is Lothar Ulmer, Kleine Heide 14, 33611 Bielefeld, Germany.
2. Offer and Conclusion of the Sales Contract
2.1. The presentation of our products in the online store does not constitute a legally binding offer, but rather a non-committal online catalogue. You place a binding order of the products in your shopping cart by clicking the button [buy] in the final check out screen of the order process. As soon as we have received your order, an automated order confirmation email will immediatly be sent to your email address. The sales contract is concluded with this order confirmation email.
2.2. All prices are indicated in Euro including VAT, but plus shipping costs.
2.3. We deliver to all countries of the European Union, to Switzerland and to the United Kingdom.
2.4. We charge a shipping flat rate of 6,90 Euro including VAT for deliveries within the European Union. Please note that deliveries within the European Union are not subject to additional duties, custom charges or taxes.
2.5. We charge a shipping flat rate of 8,90 Euro including VAT for deliveries to Switzerland and 14,90 EUR including VAT to United Kingdom. Please note that additional costs (customs duties, costs for customs clearance and VAT) might incur for import of goods. Switzerland: A VAT of 8% on the value of the goods (total amount of invoice incl. shipping costs plus customs duties plus costs for customs clearance) could be imposed. The costs for customs clearance are 12 CHF plus 3% of the value of the goods, an additional amount of 13 CHF plus VAT could incur if a customs inspection, value clarification and storage of the shipment is conducted. Customs duties for imports from the European Union to Switzerland are not imposed on the products offered on EscrimaEurope.com.
3. Right of withdrawal for consumers
3.1. Consumers have a 14-day right of revocation:

You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.
To exercise the right of withdrawal, you must inform us (Lothar Ulmer, Kleine Heide 14, 33611 Bielefeld, Germany - Phone: +49(0)521-91453842, E-Mail: service@escrimaeurope.com) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You may use the attached model withdrawal form, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
3.2. The right of revocation does not apply for deliveries of goods which have been manufactured according to customers specification or which are clearly tailored to personal requirements.
4. Payment and Delivery
4.1. The payment of the total amount has to be made in advance either by bank remittance to the bank account indicated in the order confirmation email, or by Paypal to our Paypal account.
4.2. We deliver after receiving the total amount in advance. Shipments are solely made from Germany and processed with Deutsche Post / DHL. The delivery time consists of the time until dispatchment plus the regular transit time of the shipment. The order will be dispatched within 2 to 4 days after payment. The regular transit time with DHL after dispatchment of the order depends on the country of destination:
Austria: 2 days, Belgium: 2 days, Bulgaria: 6 to 9 days, Croatia: 7 to 8 days, Cyprus: 8 days, Czech Republic: 3 days, Denmark: 2 days, Estonia: 9 days, Finland: 6 days, France: 3 days, Germany: 1 to 2 days, Greece: 10 to 12 days, Hungary: 6 days, Ireland: 8 days, Italy: 3 days, Latvia: 6 to 12 days, Lithuania: 6 to 12 days, Luxembourg: 2 to 3 days, Malta: 6 to 9 days, Netherlands: 2 to 3 days, Poland: 3 days, Portugal: 9 days, Romania: 6 to 8 days, Slovakia: 3 to 4 days, Slovenia: 4 days, Spain: 6 to 7 days, Sweden: 4 days, Switzerland: 4 days, United Kingdom: 3 days.
Regarding shipments to Switzerland: please note that eventual customs procedures might delay the shipment.
4.3. Orders will be sent to the provided delivery address. Any additional delivery information (e.g. further instructions in order to facilitate the final delivery) has to be provided by the customer to us. The costs for a repeated shipment due to an inaccurate delivery address will be charged to the customer.
5. Warranty
In case of a defect the statutory regulations apply.
6. Place of Jurisdiction and Applicable Law
6.1. For business transactions with merchants and legal entities governed by public law, the place of jurisdiction for all legal disputes resulting from this contract is Bielefeld in Germany. However, we reserve the right to take legal action at the place of domicile of the buyer.
6.2. The German law is exclusively applicable, to the exclusion of UN sales law. The application of the mandatory norms of the state where the customer has his/her customary place of residence at the time of the conclusion of the contract remains unaffected by this choice.

Order Process
The order process of our online shop system has 4 steps.
In the first step you select the items from EskrimaEurope.com which you would like to add to your virtual shopping cart of our online shop system. You can add items to your shopping cart without any commitment by clicking the button [Add to Cart]. You can display the actual content of your shopping cart without any commitment by clicking the button [Shopping cart]. You can remove any item from your shopping cart at any time just by clicking the red cross in the column "Remove" beside the item. If you like to change the order quantity of any item, please confirm your change by clicking the button [Update] after editing the order quantity. If you like to proceed with the next step, please click the button [Checkout] in the shopping cart.
In the second step you can select the method of shipment, if more than one is available. You can edit the shipment address by clicking the button [Edit Address]. If you like to proceed with the next step, please click the button [Continue].
In the third step you can select the method of payment, if more than one is available. You can edit the billing address by clicking the button [Edit Address]. You also can input any message or advise you would like to send to us with your order. In case you wish that the items of your order have a certain configuration, please give us the details here, also if you have further instructions regarding the exact location of the delivery address.
Please read the terms and conditions which are displayed in a scroll box. You can save the terms and conditions by clicking with the right mouse button into the window with the terms and conditions, and choosing "Save page as...". You also can save the terms and conditions by copying and pasting the text into any text editor software on your computer. Please confirm that you read and accept the terms and conditions by checking the checkbox below the window with the terms and conditions. If you like to proceed with the next step, please click the button [Continue].
In the fourth step you have the possibility to check and edit all information (shipment address, billing address, shipping method, payment method and included items). If necessary, you can edit the information by clicking the corresponding link [Edit]. You can also view the terms and conditions and the instructions on the right of revocation for consumers by clicking on the corresponding link [More]. The order process can be cancelled at any time just by closing your browser window. If you like to conclude the order and purchase the items, please click on the button [Buy]. After the purchase order process has been concluded successfully, an order confirmation email will be generated by the shop system and sent to your email address. This email contains the order information, terms and conditions, as well as the payment information.
Concluded Contract
The concluded contract (order details and terms and conditions) will be sent to the customer with the order confirmation email. The text of the concluded contract will be stored and archived in our internal system. It can be sent free of charge to the customer on request. The actual terms and conditions can be viewed and printed at any time on this webpage.
